E-2 Investor Visa

Foreign nationals from 80 countries that have a treaty with the US are eligible. Requires a substantial invesment and 5 year business plan. You can invest in starting a new company, a franchise, or purchase an existing business. E-2s are granted up to 5 years and can be extended indefinitely.

Treaty Country

Must be a national from a treaty country.

Substantial Investment

Depends on type of business, location, market, and other factors.

Source of Funds

Evidence of lawful source of funds used to make the investment.

Real & Operating

You must invest in a real and operating enterprise.

50% Ownership

You must have at least 50% ownership in the business.

Pass Marginality Test

Show income to support your family & contribute to US economy.

At-risk Investment

You control the funds and the investment is subject to loss.

Develop & Direct

You must be coming to the U.S. to develop and direct the enterprise.

*An E-2 escrow agreement can be used to purchase a franchise or an existing business, which can mitigate some commercial risk. This solution is not available when starting a new business.
